These Terms & Conditions (“Terms”) govern your use of the Up In Smoke BBQ website, mobile application, online ordering platform, and related services (collectively, the “Services”).

1. Eligibility

2. Online Ordering
When placing an order, you agree that:

3. Menu Availability

4. Payment
Payment must be completed before an online order is prepared unless another payment option is offered.
Accepted payment methods are displayed during checkout.
All transactions are processed securely through trusted third-party payment processors.
5. Pickup Orders
Customers are responsible for arriving during the selected pickup window.
Orders not picked up within a reasonable time may no longer be at optimal quality. We are not responsible for food quality after extended delays in pickup.
6. Delivery Orders
Delivery availability depends on your location and driver availability.
Estimated delivery times are estimates only and may be affected by:
- Traffic
- Weather
- High order volume
- Road conditions
- Other unforeseen circumstances
Delivery fees, if applicable, are shown during checkout.
7. Order Accuracy
Please review your order carefully before submitting it.
Once an order has been confirmed, changes or cancellations may not be possible because food preparation may begin immediately.
If you believe your order contains an error, contact the restaurant as soon as possible.
8. Refunds and Credits
Because our food is prepared fresh to order, completed orders are generally non-refundable.
Refunds, replacements, or store credit may be provided at our discretion if:
- An incorrect order was prepared.
- Food quality did not meet reasonable expectations.
- An item was missing from your order.
- A verified service issue occurred.
Approved refunds are issued to the original payment method whenever possible.
9. Loyalty Rewards
Participation in our rewards program is voluntary.
We reserve the right to:
- Modify reward values
- Change earning or redemption rules
- Expire promotional rewards
- Suspend or terminate accounts for abuse or fraud
- End the rewards program at any time
Rewards have no cash value unless required by law.
10. Coupons and Promotions
Coupons, discounts, and promotional offers:
- Cannot be combined unless specifically stated.
- May expire without notice.
- May have minimum purchase requirements.
- May exclude certain menu items.
- Have no cash value.
We reserve the right to modify or discontinue promotions at any time.
11. Gift Cards
Gift cards, if offered:
- Are redeemable only at participating Up In Smoke BBQ locations.
- Cannot be redeemed for cash except where required by law.
- Should be treated like cash.
- Lost or stolen gift cards may not be replaceable.
12. User Accounts
If you create an account, you are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Providing accurate and current account information.
Notify us immediately if you believe your account has been accessed without authorization.
13. Acceptable Use

While we take reasonable precautions, we cannot guarantee that any menu item is completely free of allergens due to shared preparation areas.

All content available through our Services, including:
- Logos
- Graphics
- Photos
- Text
- Menus
- Designs
- Branding
is owned by Up In Smoke BBQ or used with permission and is protected by applicable intellectual property laws.
No content may be copied, reproduced, or distributed without prior written permission.
16. Limitation of Liability
To the fullest extent permitted by law, Up In Smoke BBQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
Our total liability for any claim shall not exceed the amount paid for the order giving rise to the claim.

We strive to keep our website and mobile app available at all times but do not guarantee uninterrupted or error-free service.
